By using the Site you agree to these terms, our Privacy Policy and any other policies we publish on the Site from time to time (together, the “Terms”). If you don’t agree, please don’t use the Site.
Using this Site
You may use the Site for lawful purposes only. You must not:
- interfere with, disrupt or try to gain unauthorised access to the Site, its servers or any connected system;
- introduce viruses, malicious code or anything else designed to harm the Site or its visitors;
- copy, scrape or harvest content from the Site by automated means without our written permission;
- use the Site in a way that is misleading, unlawful or infringes anyone’s rights, including to send unsolicited messages.
We may suspend or restrict access to the Site at any time, including for maintenance.
Intellectual property
All content on the Site — including its design, text, graphics, animation, video, code, logos and the Arc character (the “Materials”) — is owned by or licensed to Archicode and protected by the Copyright Act 1968 (Cth) and other laws.
You may view the Materials, and print or save a copy for your own reference or internal business use. Otherwise, you must not reproduce, adapt, distribute, publish or transmit any Materials without our prior written consent, except as the law allows. The Archicode name and logo may not be used without our permission.
Copyright concerns
We respect other people’s intellectual property. If you believe material on the Site infringes your copyright, email support@archicode.com.au with details of the material and your rights. We review every notice promptly and, where appropriate, remove or disable access to the material.
Enquiries and proposals
Information on the Site is general in nature and is not an offer to supply services. Any estimate, timeframe or price range we discuss is indicative until it is confirmed in a written proposal.
Submitting a project brief or contacting us doesn’t create an engagement or any obligation on either side. We are happy to sign a non-disclosure agreement before detailed discussions.
Project engagements
Each project is governed by a written proposal or statement of work and our services agreement, which set out the scope, deliverables, milestones, fees and acceptance process. If anything in that agreement conflicts with these Terms, the agreement applies. Unless it says otherwise:
- ownership of the custom work we create for you passes to you once it has been paid for in full;
- we keep ownership of our pre-existing tools, components and know-how, and grant you a licence to use them as part of what we deliver;
- third-party and open-source software included in a solution stays subject to its own licence terms;
- changes to the agreed scope are quoted and approved in writing before the work is done.
Fees and payment
Fees, deposits and payment milestones are set out in your proposal. Unless we agree otherwise:
- prices are in Australian dollars and exclude GST, which is added where applicable;
- we may ask for a deposit before work begins;
- invoices are payable by the due date and through the payment methods shown on the invoice;
- a surcharge may apply to card payments, and will be shown on your invoice.
If a payment is overdue we may pause work until the account is up to date, and you agree to cover reasonable costs we incur in recovering overdue amounts. Please raise any question about an invoice in writing before its due date. Except as required by law, fees for work already performed are non-refundable.
Confidentiality
We treat what you share about your business, customers and systems as confidential and use it only to deliver your project. Where an NDA or services agreement applies, its confidentiality terms govern. We will only name you as a client, or show your project in our portfolio, with your permission.
AI-assisted work
We use AI tools alongside our team to help design, write and test software. Everything we deliver is reviewed by people, and we remain responsible for the quality of our work.
Where a solution includes AI features, their outputs can sometimes be inaccurate or incomplete. They should be used with appropriate human oversight — particularly for decisions that affect people, money or safety.
Third-party links and social media
The Site may link to third-party websites and services, including our LinkedIn profile. We don’t control and aren’t responsible for their content, availability or privacy practices, and a link doesn’t mean we endorse them. You’re welcome to link to the Site, as long as you don’t suggest a partnership or endorsement that doesn’t exist.
Disclaimer
We work hard to keep the Site accurate and available, but it is provided “as is”. To the extent permitted by law, we make no warranty that the Site or its content is complete, current or error-free, or that the Site will be uninterrupted or free of viruses. You use the Site, and anything you download from it, at your own risk.
Limitation of liability
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law that cannot be excluded.
Subject to that, and to the extent permitted by law, Archicode is not liable for any indirect, incidental, special or consequential loss — including loss of profit, revenue, data or opportunity — arising from your use of the Site. Where our liability can be limited but not excluded, it is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again. We are not liable for any failure or delay caused by events beyond our reasonable control.
Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Archicode submit to the non-exclusive jurisdiction of the courts of that state and of the Commonwealth of Australia.
